1. What Ayavi is
Plain English: Ayavi is a licensed-professional bid board. Customers post scoped work; verified pros submit sealed bids; the customer picks one. Ayavi does not perform the work, sell leads, or hold job payments. the pro invoices the customer directly.
Ayavi LLC (“Ayavi,” “we,” “us”) operates an online bid board at ayavimarket.com (the “Service”). Customers post jobs with scope, location, urgency, and supporting media. Eligible licensed professionals (“pros”) may view those postings and submit fixed-price bids. The customer may accept one bid, which closes the listing. Acceptance creates a direct contract between the customer and the pro on the terms of the bid. Ayavi is not a contractor, employer, agent, broker, or representative of any pro. Ayavi does not perform, supervise, warrant, or guarantee any work. All work, contracts, payments, warranties, and disputes are between the customer and the pro.
Ayavi is not a lead-generation or matchmaking service. We do not sell customer contact information, resell inquiries, or charge pros per lead, impression, or introduction. Platform fees are described on our Billing & Refunds page.
2. Eligibility
Plain English: You must be 18+ and able to enter contracts. Pros must hold valid state licenses and required insurance for the work they bid on.
To use the Service, you must be at least 18 years of age and capable of forming a binding contract. Pro accounts additionally require a current state-issued license appropriate for the trade and jurisdiction in which work is offered, plus insurance as required for that vertical (for example, general liability for construction trades; errors & omissions for real estate and financial roles), verified to the extent described in our verification process.
3. Accounts
You are responsible for your account credentials and all activity under your account. Notify us immediately at legal@ayavimarket.com of any unauthorized access. You must provide accurate, current information and update it as needed. We may suspend or terminate accounts at our discretion for violation of these Terms, license expiration, insurance lapse, or for safety reasons.
4. The bid-board transaction
Plain English: Post once. Sealed bids come in on the same scope. Pick one. The pro performs the work and bills you directly. Ayavi runs the board, not the job payment.
Ayavi hosts job postings and sealed bids. When a posting goes live, eligible pros in the relevant license category and service area may be notified and may claim a bid slot (where applicable), ask scope questions, and submit fixed-price bids. The customer sees bid amounts; other bidders see counts only until the customer accepts. Acceptance of a bid creates a direct contract between the customer and the pro. Ayavi is not a party to that contract. Ayavi does not collect, hold, or transmit customer job payments to pros.
4.1 Our role. what we will and will not do
Plain English: We host the bid board and verify credentials. We don’t mediate fights, judge work quality, refund payments we never received, inspect job sites, or give legal advice.
Ayavi is a marketplace facilitator and bid-board operator. Our role is limited to: (a) hosting job postings and bids, (b) notifying eligible pros when a posting in their verified category and service area goes live, (c) verifying pro license and insurance status at onboarding and on a recurring basis to the extent reasonable, (d) preserving the structured contract record (the accepted bid plus any approved change orders), (e) preserving scope Q&A and platform message logs, (f) collecting and reviewing complaints filed through our complaint form, (g) operating a two-sided review system after completed jobs, and (h) charging platform fees described on our Pricing and Billing pages.
Ayavi will NOT: mediate or arbitrate disputes between customers and pros; adjudicate price disputes, scope disagreements, or workmanship disagreements; inspect work for code compliance, quality, or completion; refund payments made by a customer directly to a pro (Ayavi never holds those payments); provide legal advice; or substitute for the appropriate forum for a dispute (state licensing board, small claims court, the customer’s card issuer, or law enforcement).
For genuinely dangerous conduct or suspected fraud, Ayavi may, at its discretion, (i) remove the pro or customer from the platform, and (ii) refer the matter to law enforcement and/or the relevant state licensing board.
Disputes about the work itself remain between the customer and the pro:
- Quality / code violation: the relevant state licensing board.
- Payment dispute (customer): your card issuer (chargeback) or small claims court.
- Payment dispute (pro):small claims court or a mechanic’s lien per state law.
- Criminal conduct or imminent safety: law enforcement.
Ayavi may, on request, provide either party with a structured copy of records we hold (original scope, accepted bid, approved change orders, scope Q&A log) for use in any of the above forums. We do not testify, opine, or advocate.
5. Fees
Customers pay a tiered posting fee based on bid count and market type (standard or commercial), as published on customer pricing. Licensed pros pay a monthly subscription for bid-board access and an award fee when a customer accepts their bid (percentage win fee on construction trades, subject to per-job caps; flat bid acceptance fee on real estate, financial, and other non-construction verticals. never a percentage of sale price, AUM, premiums, or commission). 6. Verification, reviews & ratings
Ayavi performs reasonable license and insurance verification at onboarding and on a recurring basis, but does not guarantee continuous accuracy. After a job is confirmed complete on-platform, both the customer and the pro may leave a rating and review. Reviews reflect completed jobs run through Ayavi only. Three substantiated complaints in 12 months may result in removal from the Service.
7. Licensed scope only
Plain English: Every posting and bid must match a verifiable state-issued license. No unlicensed work, no scope outside your credential.
Every job posting, bid, and acceptance must match a verifiable state-issued license (or equivalent regulatory credential) held by the pro who will perform the work. Customers may not use the Service to solicit unlicensed work or services outside a pro’s verified scope. Pros may not bid on or accept work outside the trade, class, or scope shown on their verified profile.
7.1 Healthcare & wellness (coming soon)
Plain English: When this category launches, it will be limited to board-licensed allied-health services, not emergency care, prescribing, or anything your license doesn’t cover.
Healthcare & wellness categories are not yet open for bidding. When launched, listings will be limited to services a cosmetology, barbering, massage, acupuncture, chiropractic, physical therapy, mental-health, or other allied-health license expressly authorizes in the customer’s state. The Service is not for medical diagnosis, emergency conditions, prescribing, surgical procedures, or inpatient care without the appropriate credential.
8. Prohibited conduct
See our Acceptable Use Policy. Violations may result in account suspension, termination, removal of content, and forfeiture of paid fees.
9. Content & licenses
You retain ownership of content you submit. By submitting, you grant Ayavi a worldwide, non-exclusive, royalty-free license to host, display, transmit, and process content as needed to operate the Service. We will not sell user content. We may use aggregated, anonymized data for product improvement.
10. Disclaimers
The Service is provided “as is” and “as available.” Ayavi makes no warranty regarding pro work quality, timeliness, code compliance, or fitness for any particular purpose. Customers are responsible for verifying scope, code, and quality before final payment to a pro.
11. Limitation of liability
To the maximum extent permitted by law, Ayavi’s aggregate liability for any claim arising out of or related to the Service is limited to the greater of (a) the fees paid by the claimant to Ayavi in the 12 months preceding the claim or (b) $100. Ayavi is not liable for indirect, incidental, special, consequential, or punitive damages.
12. Indemnification
You agree to indemnify and hold harmless Ayavi from any claim arising from your use of the Service, your content, your violation of these Terms, or, in the case of pros, work performed for any customer introduced through Ayavi.
13. Dispute resolution
Disputes between a customer and a pro are between those parties. Disputes between you and Ayavi will be resolved by binding individual arbitration under AAA Consumer Rules, except for small-claims disputes and equitable relief. You and Ayavi waive class actions and class arbitration.
14. Governing law
These Terms are governed by the laws of the State of Massachusetts. Where applicable consumer protection laws of your state of residence provide stronger protections, those apply.
15. Changes
We may update these Terms. Material changes will be communicated via email and on the Service at least 14 days before they take effect.
